Legal Advise

Consumer Law in India is mostly based upon Consumer Protection Act 1986, which contains a little over 30 provisions/sections and it was last amended in the year 2002. We try to offer free basic advise to enable you as a consumer to decide as to what steps you can take or what  kind of action you can initiate against the wrongdoer company only and otherwise paid advise is also available. (Please go through our Disclaimer also!)

Free Advise:

You submit a complaint. The complaint is reviewed and approved for posting in the website’s complaints section. In the next few days, selected complaints are either by the some companies themselves or else replied by some qualified legal person either through email or in the comments below the complaint. (P.S. Due to the huge number of complaints received at our end and our busy schedule, selected complaints are only replied)

    Sir, I am a native place of Orissa. I had applied for the Planning Approval for Buiding at Rourkela Development Authority (RDA) two years back. Till date, they have not passed my plan. A had sought the information through RTI which is pending at Orissa Information. I was informed the road to your site is encroached and you have to revised your plan by giving sufficient road. My contention is mine is a small piece of vacant plot, I can not give public road from my land. They are playing cats & mouse game with me. I want to file a case in this regard. Kindly advise me if possible if any local lawyer address, name etc.

    Dear Sir/Madam,
    I recently made a purchase from an online store at ___________________.com Online shopping in India – Buy TV Teleshopping Products at affordable prices. The product is the X5 Steam mop, 2days after receiving the product, it malfunctioned and has actually electrocuted me on use. The customer care has not responded to my many phone calls and emails/sms’s. They put my call on hold when I demand to talk to the manager and then do no pick up my calls after. So much for the so called 24×7 service (Customer Support Tel: 097184037920). It has been 21 days since the product arrived and with 9 days left for their “guarantee” I am in need of some legal advice regarding this issue. Any help will be much appreciated.

    Hi ,

    I have booked a flat in Daund (Dist -Pune) in May 2011 and did the registration in Sept 2011 . At the time of booking builder said we will be getting possession in Feb 2012 , but its End of May 2012. No issues here , but when we asked about why the delay ,builder used Insulting / coarse language . Can I lodge a complaint against the builder for the insulting language used ?

    There are huge power cut in Ram Murthy nagar Bangalore…. if childrens have exam they can not prepare for their examinations…. the power cutting is more then any village in Bangalore…. we are ssuprised that how bangalore is equalent to metro city….. good education city…. IT City….
    power supply is very worst than villages….

    I don’t know whether any body will consider our request. but I would say … to save Benguluru image ….. BESCOM should go from here.

    Their help line is fake. They can’t Help.

    hello sir/madam,
    i am dip from daman. i had a owned house in a chawl at daman. In 2007 the whole chawl including my house was demolished as it got too old for human stay. It was reconstructed in 2008 in form of five storey building with the sum of total 34 flats and 6 shops.we been promised by the owner of the chawl that we will get a same carpet area of our house for free but since then he has neither giving us a flat nor confirmation that we will get it soon. it is almost five years we been living in rented house and property value has gone up thrice the value of 2007. Now, i am frustrated of being a questioner at the builder doorstep. i want file a suit please guide me through this.
    where can i file the suit and whom to hire?

    Invoking Consumer Protection Act against Viveks OMR for delivering a faulty equipment and not being responsive / responsible for replacing the faulty equipment.

    I had bought a Voltas Split A/C 1.5 Ton Vertis Premium from Viveks in Sep 2011. Even during Installation, the equipment delivered to our house was faulty and the Installation Engineers replaced the Indoor Unit on the subsequent day. Since the time I have been encountering problems in the A/C. There was frequent Ice Formation, Crackling Noise and a constant hum that is louder than what we expect from a A/C. In the summer months when we began to use the A/C more frequently, the problems magnified and right now the A/C unit is pretty much non-functional.

    List of Problems that confirmed that I was given a faulty and/or old equipment:

    1. There is structural damage in the Indoor Unit Metal Guage
    2. The Fuse Wire within the Circuit Board has been tampered with
    3. The Outdoor Unit continues to function (i.e. fan rotates) even when I switch off the Indoor Unit
    4. The A/C has been consuming power without actually providing cooling.

    I have been following up Over Phone and In-Person with Viveks to look into the issue and get me a replacement which has been met with promises of repairing the unit. Considering the fact that the A/C is a new unit (within warranty) and the fact it is a faulty equipment, I demand a replacement. I am unable to understand how a reputed retailer such as Viveks can overlook basic Quality Checks to ensure that Customers are delivered Fault-Free equipment. What is more shocking is the indifferent attitude, careless responses and empty promises I get from Viveks.

    I have made it clear to Viveks that I intend to file a complaint with the Consumer Protection Act Council with relevant documentary and photographic evidence that illustrates the nature of the problem I have been facing after having bought the A/C unit from my favorite Home Appliances Store.

    Dear Sir,

    My name is Jitendra Singh Gahlot. i complaint against State Cargo Mover & Packer at Old seema Puri.
    i have tie up with state cargo for sifting Delhi to Lucknow deal with Rs-7000/- but charge last minute that charge Rs 10500/- and give him finally. after this his commitment next day delivered at lucknow address but his deliver after 3 days at mid night and all goods is very bad condition and damage.

    Please give me the suggestions what are doing for this type of complaint.

    respected sir / madam
    I am doing a business of computer Sales, Service & Repairs; in some cases & some time i took services repairing work of my customer’s computer laptop from another authorized or private service & Repairing center.
    So i gave my customer laptop to another private service & repairing center to repair (solve) the problem of laptop.
    after 2 days the private service center gave me the report of laptop 1) Bios of Laptop must repair 2) some another repair & estimate amount for repair (solve)problem of laptop, Thus i had conversation with my customer on that but customer were not agreed to pay that much of estimated amount for repair (solve) problem of laptop. because of this i took back the my customer laptop from that private service & repairing center & i gave the laptop back to my customer but after 2 days my customer call me & told me following story……
    my customer went to service & repairing center where his cousin brother is presently working & there report about the laptop are 1) the laptop has been handled very badly. 2) Some electronic IC’s chips of the laptop motherboard were miss & removed. 3) unnecessary places of laptop motherboard were try to worked on it. 4) Service & Repairing Method Or Technique is very unprofessional. 5 ) before few months my customer has upgrade his laptop RAM ( Electronic Part ) from his cousin brother’s service & repairing center, & according to my customer cousin The genuine / original motherboard has removed from the laptop & replaced it to another bad motherboard in my customer laptop.
    Next day after this conversation me & my customer went to his cousin service & repairing center & i personally saw the status of the laptop, i understood that, 5 points of the report which has given by my customers cousin’s service center are TRUE. I have been got in fraud deal with another private Service & repairing center where i am took service & repair in some cases & some time.
    I request to you please give me the legal advice to face & solve this problem.

    i purchased a refill pack of dettol hand wash185 ml on 26 june 2012. at home i cut refill pack and i filled hand wash bottel and i saw quantity of refiil pack was less than 150 ml. that is wrong and it is fraud. pls advise me what to do i?

    Dear Sir, Madam,

    I have paid to IIPM Mumbai in cash Rs. 25,000 for booking the sit for my sons admission. Since their fees is very high and also the instalment of 3 years we have to pay in 5-6 instalments of 2 lacs each which I found that I could not afford after checking with banks for loan. For whole month I am following up with IIPM Delhi to return my money but they go quit after the coomunication, I have even email and sms to them without response. On 23/6/12 I visited IIPM Mumbai for the same purpose they made me to talk to Delhi who assured me to call on Monday 25/6/12 which they didnt. Today I called them to find out to my surprise they said the amount could not be returned. This is not a small amount and I humbly requested them to help but in vain. Kindly help me to get my money back. Regards,

    I have Hitachi split AC which is under AMC, Now, AC is not working, I registered service complaint on 07-06-2012, but till now no technician turned up for service, Can I file a complaint against hitachi in the customer court? please give suggestion

    I filed a case of PR of canada through CWC immigration solution punjab in August2007

    They charge 50,000 as consultant fee. But because of changes in the immigaration law
    My immigration file is returned and embassy fee
    also come back. But cwc dnt retune money that i pay as consultancy fee.
    What i do knw. My embassy fee was returned in2009. But still cwc dnt refund my money.

    Dear Sir,

    I have been victim of ICICI PRUDENTIAL LIFE INSURANCE CO,

    I have purchased a policy No: 05011157 dt 31.07.2007.

    The adviser MR. Akhilesh Kr. Jha insisted to purchase the policy. He assured me that the full amt of premium will be refunded with some bonus after 3 yrs ( i.e lock period of policy)

    I agreed and paid Rs. 700/- every month by ECS for 3 yrs.

    After 3 yrs I enquired about my fund value.

    I was shocked to know that I had paid Rs 25200/- in 3 yrs and fund value was Rs. 23026/84.

    I decided to surrender the policy. I was paid Rs. 11623/98 by cheque No: 837372 dt 07.09.2010 by ICICI BANK LTD.

    Thus I lost 20,000/- approx.

    I feel like cheated.

    Kindly look into the matter.

    Dear Sir / Madam,

    I bought a E5 Nokia two months back for 9000/ Rs. Inspite of proper handling the front cover has become loose and the display screen is hanging out from one corner. There is some discussion about faulty front covers for some models for Nokia product and in other countries consumers have got replacements for such defects.

    I have visited Nokia Care centre and shared the problem with the centre. The centre’s response was that this aspect is not covered under Warranty. They said that they will repair my loose front screen with glue and hand it over to me. However I insisted that it is a manufacturing defect and the company should replace this as a defect product. The centre in-charge finally suggested that it will be forwarded to Company main centre where decision will be taken for its repair / replacement. They gave me an alternative handset so that I can remain connected.

    I want to put forward the following points:

    • the loose front screen is a manufacturing defect. This has not occurred due to customer’s fault .In case the customer spends 9000 Rs. on a high end business phone and invests in Nokia the company should be open to accept complaints for any such major defects. There are also discussions on web which point out loose and faulty front covers.(since 2009). I am still surprised that such faulty handsets are floating in the market

    • The company is keen to project this as a abuse from customers end and will most probably refuse to replace the handset. Their nodal person called me and repeated that it is not a manufacturing defect

    I request you to kindly guide me how to take up this complaint further to the management

    Dell Laptop sent an engineer in 2010 to replace the DVD & touch pad 2 months after I purchased it. Their engineer was in a bad mood & spoilt my laptop instead. I have the Repair Order form where I gave my comments on his performance. After chasing them for around 1 year, where i was harassed like anything, I approached the National Consumer Helpline. After sending them 2 speedposts which they didnt bother to reply, I filed a case at the District Consumer Forum at Hyderabad for 2 lakhs compensation. After 1 year, the case was closed in my favour. But I was awarded only 5k compensation. I appealed to the State Consumer Forum. Inspite of overwhelming evidence in my favour & the fact that I was deprived of a laptop while I relocated to Delhi for 7 months, the only reason I purchased the lapytop in the first place, how could the District Forum award me only 5k???

    Educational institute not paying money to trainer… there has been no agreements prior to that.

    What evidence. to collect in my favour to report this …..in consumer court.

    Students can be witness that the trainer has been teaching.

    Will a video shoot on this would help where the institute accepts that they are delaying money.
